Paxil lawsuits

Paxil, an antidepressant manufactured by GlaxoSmithKline has been developed from the drug known as paroxetine. This drug is primarily sold in the United States and Canada. Considerable amount of emotional outbursts have been registered by the FDA in teenagers and children. It is evidenced that children and teenagers consuming this drug are prone to violence and suicidal tendencies. It is also evidenced that pregnant mothers consuming this drug are susceptible to birth defects in their children. Defects in birth may be listed as cardiac problem, pulmonary problem, brain and spinal cord problems, defects in shape of the skull, defects in the abdominal wall, feet turning inwards or outwards, closure of the anus completely or partially etc. Pregnant mothers have the right to claim against these defects which are not specified in the drug.

Paxil has been recognized as the drug with serious withdrawal symptoms. In addition to adults, this drug has also been prescribed for children. It is legal to file suit against this drug as GSK has accepted the suppression of the negative effects of the drug. Several lawsuits have been filed by people who have consumed Paxil, as they suffered certain negative effects of the drug. For instance, a lawsuit against Paxil was filed by the grand parents of a 20 year old adult who had committed suicide when his symptoms worsened after the intake of the drug. The litigation claims that the drug fails to warn about the suicidal thoughts that arises from the consumption of the drug. GlaxoSmithKline had so far settled several lawsuits claiming against the harm caused by the usage of the drug. GSK was also accused by the governmental entities for illegally releasing the generic version of Paxil, which burdened the government with heavy payment while implementing the health programs. GlaxoSmithKline agreed to pay fourteen million US dollars as compensation for the states affected by the usage of this drug.

Next important factor is the withdrawal syndrome caused when the user withdraws the drug. Paxil lawsuits also included these withdrawal effects that have been filed officially. It is the feeling of the users that this suit should also be filed against all the other antidepressants causing harmful effects. The companies marketing addictive drugs without displaying proper warnings on the label against the harmful effects of their drugs should be made accountable for the consequences arising out of their negligence.

According to the World Health Organization, the withdrawal effects of Paxil are much worse when compared to those of benzodiazaphines which is a notorious drug that has serious withdrawal effects. The serotonergic agents including Prozac, Zoloft and Paxil have similar effects due to their chemical properties. Whether it is initiation or withdrawal of the drug, gradual increase or decrease should be made mandatory. In the United States, many victims have filed lawsuits over the withdrawal syndrome of Paxil. In 2001, about 35 people filed suit against GSK. These people come from all walks of life. They had experienced similar withdrawal effects.

The complaints against Paxil alleged that this drug causes serious withdrawal reactions which were not expected by the physicians or the patients and that the manufacturer had failed to warn against these ill effects, with a motive. Patients and doctors are not aware that the drug is addictive, because a warning to that effect has not been given by the manufacturer. Another allegation is that Paxil creates psychological and physical dependency, but there is no caution from the manufacturer against continuing this drug. The charges framed by the above users include fraud and deceit, breach of warranty and negligence from the manufacturer's side.

Let us hope that at least in future, the manufacturers of antidepressants and addictive drugs such as Paxil follow the government rules and regulations religiously, so that the users of these drugs do not get victimized only because that they have used it.
